Terms of Service
Article 1 (Purpose)
These Terms of Service (hereinafter "Terms") govern the rights, obligations, and responsibilities between MailPass (hereinafter "Company") and users in connection with the use of email authentication and delivery services (hereinafter "Service") provided by the Company.
Article 2 (Definitions)
The definitions of terms used in these Terms are as follows:
- "Service" refers to OTP email authentication, bulk email delivery, subscriber management, and other email-related services provided by the Company.
- "User" refers to members and non-members who use the Service in accordance with these Terms.
- "Member" refers to a person who has registered by providing personal information to the Company and can continuously use the Service.
- "API Key" refers to a unique authentication key issued to members to use the Service.
Article 3 (Effect and Amendment of Terms)
- These Terms become effective by posting on the Service screen or notifying users through other methods.
- The Company may amend these Terms within the scope that does not violate applicable laws.
- When the Company amends the Terms, it shall announce the effective date and reasons for amendment along with the current Terms on the Service homepage from 7 days before the effective date. However, for amendments unfavorable to users, announcement shall be made from 30 days before.
- Users have the right not to agree to the amended Terms. If users do not agree to the amended Terms, they may discontinue using the Service and withdraw.
Article 4 (Provision and Modification of Service)
- The Company provides the following services:
- OTP (One-Time Password) email authentication service
- Bulk email delivery service
- Subscriber list management service
- Email template creation service
- Delivery statistics and analytics service
- Other services determined by the Company
- When the Company changes the content of the Service, it shall notify users of the changed content and the provision date.
Article 5 (Establishment of Service Use Agreement)
- The Service use agreement is established when a user agrees to the Terms, applies for use, and the Company accepts it.
- The Company may not accept applications that fall under any of the following:
- Using a false name or another person's information
- Providing false information or not providing required information
- Applying with the intent to misuse the Service
- Applying in violation of applicable laws or to harm public safety and order
Article 6 (Changes to Member Information)
Members can view and modify their personal information at any time through the personal information management screen. However, modification of email and other information necessary for service management may be restricted.
Article 7 (User Obligations)
Users shall not engage in the following activities:
- Registering false information during application or modification
- Misappropriating another person's information
- Altering information posted by the Company
- Infringing on copyrights and other intellectual property rights of the Company or third parties
- Damaging the reputation of the Company or third parties or interfering with their business
- Sending spam, phishing emails, or emails for illegal purposes
- Sending commercial advertising emails without the recipient's consent
- Illegal activities using the Service
- Other activities that violate applicable laws or regulations set by the Company
Article 8 (Restriction and Suspension of Service Use)
- The Company may restrict or suspend service use without prior notice if a user violates the obligations in Article 7.
- The Company may restrict or suspend all or part of the Service in the following cases:
- Unavoidable circumstances due to maintenance work on service facilities
- Force majeure events such as natural disasters or national emergencies
- When normal service provision is impossible due to service facility failure or usage surge
Article 9 (Service Fees)
- Service fees and payment methods shall be as separately determined by the Company.
- When changing service fees, the Company shall announce the changes 30 days before the effective date.
- Refund policy for termination during paid service use shall be as separately determined by the Company.
Article 10 (Ownership of Copyrights)
- Copyrights and intellectual property rights to the Service belong to the Company.
- Copyrights to content created by users using the Service belong to the users.
- Users may not use information obtained through the Service for commercial purposes or allow third parties to use it through reproduction, transmission, publication, distribution, broadcasting, etc., without prior consent from the Company.
Article 11 (Personal Information Protection)
The Company strives to protect users' personal information in accordance with applicable laws. The protection and use of personal information are governed by applicable laws and the Company's Privacy Policy.
Article 12 (Compensation for Damages)
- The Company shall not be liable for any damages incurred by users in connection with services provided free of charge, except in cases of intentional misconduct or gross negligence by the Company.
- The Company shall not be liable for users' failure to obtain expected profits from using the Service.
Article 13 (Disclaimer)
- The Company is exempt from liability when unable to provide the Service due to force majeure events such as natural disasters, wars, or service suspension by telecommunications carriers.
- The Company shall not be liable for service disruptions caused by users' own fault.
- The Company shall not be liable for the content of emails sent by users using the Service.
Article 14 (Dispute Resolution)
- The Company and users shall make all necessary efforts to amicably resolve disputes arising in connection with the Service.
- Matters not specified in these Terms shall be governed by applicable laws and customs.
- In case of litigation regarding disputes arising from service use, the court having jurisdiction over the Company's location shall have jurisdiction.
Article 15 (Special Provisions for Email Delivery)
- Users may send commercial advertising emails only with the explicit prior consent of the recipient in accordance with applicable anti-spam laws.
- Users must include opt-out instructions in all emails sent.
- If a user violates applicable laws such as sending spam emails, the Company may immediately suspend service use and terminate the agreement, and all legal responsibility arising therefrom lies with the user.
Addendum
These Terms shall be effective from January 11, 2026.
